A Fatal Car Crash Can Devastate Families

A fatal accident is a horrific tragedy for surviving family members. Often they are faced with unexpected medical bills, funeral bills, loss of income, and grievous heartache from losing a loved one. Nothing can ever replace a lost life. If the fatal accident was caused by another person’s carelessness, surviving family members may have a legal claim. Study Reveals Surgeons Make 1,000’s of Surgery Errors

Surgery Errors Documented in Medical Study

Surgeons make surgery errors more than 4,000 times each year, according to a Johns Hopkins University School of Medicine study published online in the journal Surgery, reported the Wall Street Journal. The study used data from medical malpractice judgments and out of court settlements.

Prior studies have shown that many patients never file claims after surgery errors. Not all items left behind after surgery are discovered. Typically, they are found only when a patient experiences a complication after surgery, such as an infection or pain after surgery, and efforts are made to find out the cause. As many as one in three or four times a sponge is left in a patient may never be discovered. Regrettably, many surgery errors are entirely preventable.

Types of Surgery Errors that are Preventable

Many surgery errors are preventable. Here are some that occur far too often, even with experienced surgeons:

  • Sponge left in after surgery.
  • Instruments left in patients after surgery.
  • Wrong site surgery.
  • Surgery on the wrong patient.

Ways to Prevent Injuries and Deaths from Surgery Errors

Hospitals have been developing safety programs to reduce surgery errors. Some of these safety programs include:

  • “Timeouts” before surgery to make sure they have the right patient, or are about to operate on the right body part.
  • New technology, such as bar-coding and wand-like scanners waved over a patient, allows surgical teams to account for all sponges and other instruments used in a procedure.
  • Using indelible ink to mark the site of the surgery before the patient goes under anesthesia.

Understanding Liability in Car Accidents in Maryland

car-crashColumbia Maryland Car Accident Lawyer

The state of Maryland is one of only a handful of states that follows the system of pure contributory negligence when it comes to recovering compensation for injuries suffered in a car accident. What is the doctrine of pure contributory negligence? Under pure contributory negligence, an injured party can recover damages only if they are not in any way at fault in the cause of a car accident. Practically speaking, this means if the court determines you were only 1% at fault in causing a car wreck, you wouldn’t be eligible to recover damages for your injuries.

Insurance Companies and the Doctrine of Pure Contributory Negligence

You can bet insurance companies are aware of the doctrine of pure contributory negligence and what it means for claims related to car accidents. That’s why insurers retain a team of accident investigators, accident reconstructionists, and medical experts. If they can gather and present evidence that you contributed to what happened, they can greatly reduce or avoid paying a claim altogether. But how often can the doctrine of pure contributory negligence affect the outcome of a car accident claim?

Well, imagine you’re driving in inclement weather. Suddenly, the car in front of you spins out or slams on the brakes and you rear-end them. You’re not at fault, right? It was the snow or ice and the bad driving on the part of the person you hit. Well, if after measuring skid marks and analyzing the damage done to your car and the one you hit, it’s likely the insurer will argue you were driving too fast or too close, given the weather conditions. Alternatively, if you were the car rear-ended, investigators will argue you contributed to the accident for similar reasons.

Other Strategies for Reducing Claims in Car Accidents

Car insurance companies won’t stop at investigating the nature or cause of an accident. In order to strengthen their case, they’ll want to talk to you, the injured person, as soon as possible after the crash. Here, an insurance agent will feign concern or interest in your condition in the hopes of gaining your confidence so that you’ll open up and answer questions that hopefully show you were negligent in some way. For example, you might be asked what you remember, if you saw brake lights, how fast you were going, if you were on your cell phone, etc.

Man Charged in School Bus Accident

Rear End School Bus Accident in Howard County

On December 4, 2012, Howard County Police charged a driver with failure to reduce speed to avoid collision, after he allegedly rear-ended a school bus, reported The Baltimore Sun.

According to police, at 7:30 a.m. a Howard County school bus was exiting Governor Warfield Parkway onto Little Patuxent Parkway westbound when it was hit from behind. Police said the school bus had slowed down on the exit ramp to look for oncoming traffic.

Fortunately, no one was injured in this school bus crash. Other bus accidents have resulted in injuries, and even deaths.

School Bus Accident Statistics

The National Highway Traffic Safety Administration compiles school bus accident statistics. Since 1998, 1,564 people have died in school transportation-related crashes—an average of 142 fatalities per year. Most of the people who lost their lives in those crashes (72%) were occupants of other vehicles involved. Non-occupants (pedestrians, bicyclists, etc.) accounted for 20 percent of the deaths, and occupants of school transportation vehicles accounted for 8 percent.

Teens Take Distracted Driving Course

Education on Distracted Driving to Prevent Distracted Driving Accidents

Howard County high school students attended a Distracted Driving Presentation to educate them on the dangers of distracted driving, reported The Baltimore Sun. “Distract driving” includes phone use while driving, cell use while driving, and texting while driving. It also can include something as simple as brushing one’s hair, or unbuckling a seat belt.

Students quickly learned the dangers of distracted driving, including the risk of texting and driving accidents. They were given a Wii steering wheel and told to navigate a virtual road in Mario Kart while texting at the same time. When the game began, one student’s video game car immediately careened off the road. Within four minutes, the four students playing the game crashed their cars more than 20 times, sometimes running into walls, driving in the opposite direction or simply driving off a cliff.

What are Causes of Distracted Driving Accidents?

Distracted driving accidents can be caused by texting while driving, and cell phone use while driving, but there are many causes. They include:

  • Texting
  • Using a cell phone or smartphone
  • Eating and drinking
  • Talking to passengers
  • Grooming
  • Reading, including maps
  • Using a navigation system
  • Watching a video
  • Adjusting a radio, CD player, or MP3 player

Distracted Driving Accident Statistics

In 2010, 3092 people were killed in crashes involving a distracted driver and an estimated additional 416,000 were injured in motor vehicle crashes involving a distracted driver, according to U. S. government statistics. 18% of injury crashes in 2010 were reported as distraction-affected crashes.

Car Accidents Caused by Distracted Driving

If you or a loved one has been injured in a texting while driving accident, or a car crash caused by cell phone use while driving, a car accident attorney experienced with distracted driving accidents can help.

Jonathan Scott Smith is a top-rated car accident lawyer, with over 30 years of courtroom experience. As you can see by his background, Mr. Smith is an experienced, respected, and credentialed trial attorney. He has successfully handled distracted driving accident cases, including texting accidents and cell use while driving car accidents, for over three decades. He fights hard for his clients. That’s why many satisfied clients think so highly of him.

Case Studies in Distracted Driving Accidents

In one case successfully handled by Mr. Smith, a driver ran a red light, swerved to avoid another vehicle, ran up onto the median, and struck a pedestrian lawfully standing in the crosswalk. The pedestrian was catapulted into the air, landing on the road. She sustained traumatic injuries, including facial fractures; leg fractures; and other serious injuries. The investigating police officer was unable to determine why the accident happened. Mr. Smith sued the driver and questioned her in a deposition, where she admitted being on her cell phone at the time of the accident. Her insurance company paid the entire policy limits.

In another case, a driver was listening to a conference call on his cell phone, while at the same time the driver was adjusting the controls on his car’s heater, during heavy rush hour traffic. He rear-ended another car that had stopped in traffic, injuring the driver. The insurance company for the distracted driver paid a personal injury settlement.
