Passengers Injured in BWI Shuttle Bus Accident

Shuttle Bus Accident Injures Three at BWI Airport

A shuttle bus overturned Sunday morning, February 10, 2013, at BWI Airport, causing injuries to three passengers, The Baltimore Sun reported. The shuttle bus overturned near the intersection of Route 170 and Terminal Road at 6:30 a.m.

The Sun reported that three people were hurt. One refused medical treatment and the other two were transported via ambulance to the Baltimore Washington Medical Center with injuries.

Legal Claims for Injuries Caused in Bus Accidents

A driver of any vehicle is legally responsible if the driver’s recklessness, carelessness, or negligence is the cause of another person’s injuries, including passengers. This is true of a bus driver when injuries are caused by a bus accident that is the fault of the bus driver. In fact, when a driver is transporting passengers for hire, the law imposes an even higher duty to avoid harm to passengers compared to drivers who are not doing it for hire.

Experienced Shuttle Bus Accident Lawyer Maryland

Jonathan Scott Smith is a top-rated accident lawyer, with over 30 years of courtroom experience. As you can see by his background, Mr. Smith is an experienced, respected, and credentialed trial attorney. He has successfully handled accident cases, including school bus and shuttle bus accidents, for over three decades. He fights hard for his clients. That’s why many satisfied clients think so highly of him.

Mr. Smith successfully handled one shuttle bus accident at BWI Airport in which a police department employee and friend were returning from a vacation trip. They took a shuttle bus from BWI Airport to an airport parking lot company. The shuttle bus driver was driving aggressively and, at one point, slammed on his brakes. This caused the passenger to be thrown forward into the armrest of another seat in the shuttle bus. The armrest padding was missing, causing the woman’s leg to slam against a sharp metal bracket, resulting in a deep laceration and eventual scar. The injured bus passenger received a fair settlement for her injuries, medical expenses, and disfigurement.

What Is Negligence in a Personal Injury Case?

Negligence happens when someone acts in a careless or reckless manner that causes injury to another person. In personal injury cases, negligence can either be caused by action or failing to take appropriate action.

In general, negligence, from the word neglect, is at the heart of many personal injury claims. It forms the legal basis necessary to mount a personal injury lawsuit.

To win a personal injury lawsuit, the injured person, known as the plaintiff, must prove these four things:

  1. The person who is being sued, or the defendant, owed the plaintiff a duty of care.
  2. The defendant failed to act with appropriate care toward the injured person.
  3. The breach of duty on the part of the defendant caused the plaintiff’s injury.
  4. The plaintiff suffered damages due to the defendant’s breach of duty. Damages means bodily injury, property damages, lost wages, and pain and suffering.

Duty of Care Examples

In the case of a car or other motor vehicle, a person’s duty of care includes following traffic laws, including stopping at red lights and following the speed limits, and not drinking while driving.

Breach of Duty Examples

A beach of duty of care can occur if the owner of a car does not properly maintain a vehicle and that car gets in an accident that causes injuries to another as a result. For example, if the brakes on a car that has not been properly maintained fail, causing the car driver to strike and injure a pedestrian, the car owner has breached his duty of care to the injured person. Had the car been properly maintained, the accident would not have happened.

Cause Examples

The injured person must show that the defendant’s breach of duty actually caused the accident that caused the injury. Sometimes this is very clear. For example, let’s say the driver of one car runs a red light, striking and injuring another individual. While this example demonstrates that all cause rests with the person at fault, not all cases are as clear-cut.

Damages

Damages are essentially an attempt by legal means to help the injured person recover as much as possible of the life that he or she had prior to the accident that caused the injuries. Damages include cost of medical treatment, lost wages, and the like. It is relatively straightforward to place a dollar value on property damage relating to a car accident, but not so easy to monetize an intangible such as pain and suffering, or to anticipate damages relating to future medical costs in the case of a person who was permanently disabled as a result of the accident.

Mt Hebron Students Injured in Car Accident

Car Accident Sends Students to Hospital

On Thursday, January 3, 2013, a car was leaving Mt Hebron High School and attemptingto pull out onto Route 99 when it was struck by a Mack truck, reported The Baltimore Sun. According to the account, the car accident involved a Honda Civic loaded with students that failed to stop at a stop sign when exiting the school’s parking lot.

The car’s driver was taken to the hospital in critical condition. The four passengers were treated and released from Howard County General Hospital the same evening. No charges were filed against the driver of the Mack truck; Howard County Police did not believe he was speeding or at fault in causing the car accident.

Can a Passenger have a Claim if their Driver is at Fault?

If you or a loved one is injured in a car accident, you may have a claim for medical bills; lost income; and pain & suffering. A passenger in a car driven by the at fault driver may still have a valid legal claim because the passenger was not in control of the vehicle and therefore not legally at fault in most cases.

Semi Truck Accidents on Maryland Highways

Causes of a Semi Truck Accidentsemi-truck-accident-maryland

Truck drivers are often pushing the pedal to the metal, literally. They are under pressure to deliver their goods within a certain time frame. And even though Federal regulations limit truckers to 11 hours’ drive time in a 14-hour time period, which must be followed by at least 10 hours’ rest, many drivers ignore the rules.

Truckers may be tired, driving 18 or more hours a day. This level of fatigue can lead to falling asleep at the wheel or inattention, which can lead to serious semi truck accidents, and often fatal accidents.

Serious Semi Truck Crashes on I-95

Just this past August, a trucker heading north on Interstate 95 in Baltimore struck a barrier wall at the Interstate 395 exit. The impact caused two tanks of fuel on the truck to catch fire and the truck’s cabin went up in flames. The driver was also killed. In another August semi truck accident, a truck driver was injured after his tractor-trailer crashed on Interstate 95, spilled oil and fuel across the highway. Two lanes were closed while Hazardous materials teams from Howard County Department of Fire and Rescue Services Special Operations Team and the Maryland Department of the Environment worked to clean it up. Causes of both crashes are being investigated.

Investigating Cause of Semi Truck Accidents

Semi truck accidents can be complicated and challenging to investigate. There can be many contributing causes to a truck crash, each of which must be investigated. In any personal injury accident case, all potential sources of liability must be tracked down. Investigators must look into the role played by:

  • The driver of the truck
  • The tractor-trailer owner
  • The trucking company
  • The auto shop that maintained the truck
  • The warehouse responsible for loading the 18-wheeler
  • The manufacturer of the truck, the brakes, the tires, or other parts that failed

If you have suffered an injury as a result of an accident involving a truck, an attorney who is knowledgeable in the rules and regulations governing the trucking industry may be able to help you find out what caused the accident and whether you have grounds to sue for personal injury or wrongful death.

Understanding Liability in Car Accidents in Maryland

car-crashColumbia Maryland Car Accident Lawyer

The state of Maryland is one of only a handful of states that follows the system of pure contributory negligence when it comes to recovering compensation for injuries suffered in a car accident. What is the doctrine of pure contributory negligence? Under pure contributory negligence, an injured party can recover damages only if they are not in any way at fault in the cause of a car accident. Practically speaking, this means if the court determines you were only 1% at fault in causing a car wreck, you wouldn’t be eligible to recover damages for your injuries.

Insurance Companies and the Doctrine of Pure Contributory Negligence

You can bet insurance companies are aware of the doctrine of pure contributory negligence and what it means for claims related to car accidents. That’s why insurers retain a team of accident investigators, accident reconstructionists, and medical experts. If they can gather and present evidence that you contributed to what happened, they can greatly reduce or avoid paying a claim altogether. But how often can the doctrine of pure contributory negligence affect the outcome of a car accident claim?

Well, imagine you’re driving in inclement weather. Suddenly, the car in front of you spins out or slams on the brakes and you rear-end them. You’re not at fault, right? It was the snow or ice and the bad driving on the part of the person you hit. Well, if after measuring skid marks and analyzing the damage done to your car and the one you hit, it’s likely the insurer will argue you were driving too fast or too close, given the weather conditions. Alternatively, if you were the car rear-ended, investigators will argue you contributed to the accident for similar reasons.

Other Strategies for Reducing Claims in Car Accidents

Car insurance companies won’t stop at investigating the nature or cause of an accident. In order to strengthen their case, they’ll want to talk to you, the injured person, as soon as possible after the crash. Here, an insurance agent will feign concern or interest in your condition in the hopes of gaining your confidence so that you’ll open up and answer questions that hopefully show you were negligent in some way. For example, you might be asked what you remember, if you saw brake lights, how fast you were going, if you were on your cell phone, etc.
