On Friday, November 16, 2012, two drivers and one student were injured after a school bus crash involving a Montgomery County school bus and a car on Route 97 in Howard County, The Baltimore Sun reported.

A police spokeswoman, Sherry Llewellyn, stated that at approximately 1:40 p.m. a Toyota Corolla traveling southbound on Route 97 clipped the school bus, which was traveling northbound, while attempting a left turn, according to the newspaper.

Woman Dies in Anne Arundel County Fatal Car Crash

Woman Ejected from SUV in Jessup Fatal Car Crash

On Friday, October 26, 2012, Christina Marie Tobash, of the 3700 block of Piedmont Ave., Baltimore died after apparently running a red light on Telegraph Road in Jessup. The 35-year-old’s vehicle crashed through a chain link fence after losing control of her vehicle, The Baltimore Sun reported. She was ejected from a 2002 Ford Explorer she was driving after swerving to avoid vehicles stopped at a red light on Telegraph Road at Annapolis Road at 2:54 p.m. She was pronounced dead at the scene.

Ms. Tobash was driving north on Telegraph Road when she approached vehicles stopped at the traffic signal. She allegedly continued through the red light, lost control and left the roadway, striking a curb and then a utility police, police said. The Explorer bounced off the pole, spun clockwise, overturned several times and crashed through the fence.

Three Men Die in Elkridge Fatal Car Accident

On Thursday, October 25, 2012, a Chevrolet Impala was traveling north bound on Route 1 in Elkridge, according to The Baltimore Sun. A tractor trailer traveling south bound attempted to make a left turn across the north bound roadway. It appears to investigators that the speeding Chevy struck the side of the tractor trailer.

Killed were Degly Ubaldo Monroy Melendez, 20, who police said was driving the car, and brothers Carlos Osorio, 25, and Oscar Osorio, 31. Police said Carlos was sitting in the front of the car and that Oscar was sitting behind him in the back. All three are from Hyattsville.

Colossus Software and Insurance Settlements – Sham?

Insurance Companies’ Use of Colossus Software to Evaluate Claimscolossus-insurance-claims

Even the most technologically challenged among us might agree that computers have made many areas of life easier. Software allows us to easily crunch large amounts of data. We use computers to communicate with our loved ones, to pay our bills, and to provide us with instantaneous information on any subject in the world.

However, drawing on computer software to resolve insurance claims has proven to be a bad idea. Allstate, Metlife, Aetna, CAN, Erie, Farmers, and other insurers are believed to use an insurance claims program called Colossus. Unfortunately, the settlement claims determined by Colossus may be inaccurate and too low.

How Does Colossus Work?

An insurance adjuster inputs the information on your claim into the Colossus software program. The software compares your claim against other claims that are similar that have been settled. For example, let’s say Jane Adams suffered a broken leg in a car crash in Howard County. The insurance adjuster would have Colossus look up the average insurance settlement for a similar injury in Howard County. It then addresses criteria such as pain and suffering and determines a settlement accordingly. The insurance adjuster then offers this settlement to the injured victim – in many cases without even leaving the office.

Sounds simple, right? Except that no one but the insurance company knows the data being used to make the claims. Colossus does not take into account that no two accidents are alike, nor are two injuries ever the same. Additionally, the software ignores your own evaluation of your symptoms; only recognizing documented medical records as authoritative.

If, say, you did not go to the hospital after your accident, your claim is automatically lowered in value. Only certain types of treatment are considered “valid” by Colossus, but you would not know which treatments. If you go to physical therapy for up to 90 days, this is considered three months’ worth of treatment. However, if you go to PT for 91 days, you receive a rating of three to six months of treatment, which receives a higher Colossus value.

Other Colossus Concerns

  • How can we be sure that the database is an objective database that is accurate?
  • What if more costly settlements are left out of the database?
  • Are complications after the initial treatment included in the cost analysis?
  • What if the victim suffers symptoms much later down the line?
  • Is the insured really being served by an adjuster simply inputting keywords like broken arm, Howard County, and car crash without even considering the location of the accident or the individual accident victim?
