What You Need to Know about Maryland’s Texting, Talking and Driving Laws

Prior to September of 2011, accident victims could face an uphill battle in claiming negligence due to texting and talking on a phone while driving. Even though drivers were barred from typing out texts, they could still legally read them while operating a vehicle.

Now, when drivers even glance at a text, they break the law. Injury victims’ claims of negligence are therefore strengthened when negotiating with and litigating against insurers and other relevant parties.

Ensure your rights are protected following a car or truck accident by contacting lawyer Jonathan Scott Smith. Attorney Smith is both a criminal defense attorney and personal injury attorney, so he understands the full legal issues involved in distracted driver accident cases.

At our firm, we can conduct the thorough investigation that is often needed following an accident, and fight aggressively for the full compensation you are owed. Call 410-740-0101 to schedule a free consultation.

Distracted Driving Can Cause a Car Accident

Driving Distracted Now a Cause of Car Accidents

Technology advances have produced remarkably sophisticated cell phones. That, together with social media, has resulted in many drivers talking on cell phones while driving; texting while driving; and reading emails while driving. Phone use while driving can now result in a car accident because the driver takes his or her attention off the road, and engages in distracted driving. There are now public safety campaigns to educate drivers, particular young drivers, about the dangers, such as http://www.enddd.org/.

Maryland Law Prohibits Cell Phone Use While Driving

A recent law enacted in Maryland prohibits the use of a cell phone while driving, including texting while driving and cell phone use while driving. There is an exception if the driver is using a hands free device, or making an emergency 911 call.

Man Injured In Train Accident with Car

CSX Train Involved in Baltimore County Train Accident with Car

On Wednesday, August 8, 2012, an intermodal CSX train traveling north from Florida collided with a Volvo at the railway’s intersection with Schaefer’s Lane near Pulaski Highway, reported The Baltimore Sun. The driver of the car in the train accident was injured and transported to Maryland Shock Trauma Center with serious injuries that did not appear to be life-threatening.

Apparently, the intersection did not have barrier arms that descend when a train is passing through, only signs warning of trains. This might have posed a hazard to the car’s driver, making a train accident more likely.

Howard County Train Derails on Same Day as Train Accident With Car

On the same day as the Baltimore County train accident, another CSX freight train briefly derailed in Woodstock, Howard County. The train was traveling east from Cumberland to Baltimore through the railway’s intersection with the 1400 block of Woodstock Road when one of its cars momentarily came off the tracks, only to return shortly thereafter.

Fortunately, no one was injured in the Howard County train accident. Two train accidents in the same day illustrates the fact that train accidents are more common than many people believe. Catastrophic injuries, and even death, can occur when a car is involved in a train wreck.

Overturned Tractor Trailer Causes Howard County Truck Accident

Semi Truck Overturns on I95 Exit Ramp to Route 100

On Thursday, July 26, 2012, Howard County Department of Fire and Rescue Services personnel responded to a semi truck accident on I-95 north. The semi truck was carrying 40,000 lbs of sugar. When the tractor trailer overturned, sugar and diesel fuel were dumped on the road, causing first responders to close the exit ramp to Route 100, reported The Baltimore Sun. Fortunately, the driver was not injured and managed to get out of the truck.

Semi Truck Accidents Can Cause Serious Injuries and Deaths

While this truck accident involved only the truck, and the driver escaped without injury, many semi truck accidents have caused catastrophic injuries and deaths. A truck accident can be caused by the truck driver falling asleep; an overloaded and overweight truck; and defective truck equipment from overuse or lack of necessary maintenance. Sometimes trucking companies and truck drivers are under pressure to keep costs down, and to move freight quickly. Safety takes a back seat, and innocent members of the public pay the price.

Howard County Teen Seriously Injured in Bicycle Accident

Columbia Teenager Injured in Car Bicycle Accident

On Monday, August 6, 2012, a Columbia teenager was injured seriously in a car bicycle accident. The 14-year old was riding a bicycle at the intersection of Governor Warfield Parkway and Twin Rivers Road at 12:50 p.m., according to The Baltimore Sun. A car drove through a green light and struck the bicyclist, resulting in a serious bicycle accident. The cyclist was airlifted to Johns Hopkins Children’s Center.

The newspaper reported that police said the preliminary investigation revealed that the teen was crossing the intersection during a “Don’t Walk” signal, when the light was red. The driver of the 2010 Nissan Murano, Yyacheslav Guzeyev, 65, of Columbia, was not charged.

Injuries and Deaths from Bicycle Accidents

In 2010, 618 people were killed, and 52,000 people were injured, in bicycle accidents in the United States, according to a leading source of bicycle accident statistics. Howard County Semi Truck Accident Blocks Route 29

Howard County Semi Truck Accident at Routes 29 and 32

At 9:35 a.m. on Friday, July 27, 2012, a tractor trailer overturned on Route 29 near its intersection with Route 32 in Howard County, causing the truck accident to block the entire road and snarl traffic, reported The Baltimore Sun. Howard County police stated that the driver of the semi truck and its passenger sustained only minor injuries.

The semi truck was the only vehicle involved in the truck accident, and police had not yet determined the cause.

Semi Truck Accident Statistics

There are approximately 295,000 truck accidents each year involving large trucks, according to the most recent federal government truck accident statistics. Only about 3% of those semi truck accidents involve a rollover.

Tractor trailer truck accidents can be some of the most serious, resulting not just in injuries, but deaths. This is because of the large size of tractor trailers, and the weight of the truck along with any cargo.

How Do You Find a Lawyer?

How to Find a Lawyer

When you need to find a lawyer, many people don’t know how to go about it, or where to start. Here are some basic ways to find a lawyer:

  • Ask family, friends, and co-workers for a referral. Often, other people you know and trust can tell you about their personal experience with an attorney.
  • Use Internet Search Engines. Using an internet search engine, such as Google, Yahoo, or Bing, can be a quick way to find lawyers. You should search both geographically and topically. For example, search “car accident lawyer” “Howard County, MD.”
  • Lawyer Directories. There are many online lawyer directories that can help you find a lawyer by searching the area of law and the geographical area where you want to find attorneys. Two of the largest and best lawyer directories are http://www.lawyers.com/ and http://www.findlaw.com/. A third trusted source is http://www.martindale.com/.

  • Ratings of lawyers (peer ratings, i.e. what do other lawyers and judges say about a lawyer’s skill and ethics)

  • Client reviews
  • A lawyer’s track record of results in actual cases
