Colossus Software and Insurance Settlements – Sham?

Insurance Companies’ Use of Colossus Software to Evaluate Claimscolossus-insurance-claims

Even the most technologically challenged among us might agree that computers have made many areas of life easier. Software allows us to easily crunch large amounts of data. We use computers to communicate with our loved ones, to pay our bills, and to provide us with instantaneous information on any subject in the world.

However, drawing on computer software to resolve insurance claims has proven to be a bad idea. Allstate, Metlife, Aetna, CAN, Erie, Farmers, and other insurers are believed to use an insurance claims program called Colossus. Unfortunately, the settlement claims determined by Colossus may be inaccurate and too low.

How Does Colossus Work?

An insurance adjuster inputs the information on your claim into the Colossus software program. The software compares your claim against other claims that are similar that have been settled. For example, let’s say Jane Adams suffered a broken leg in a car crash in Howard County. The insurance adjuster would have Colossus look up the average insurance settlement for a similar injury in Howard County. It then addresses criteria such as pain and suffering and determines a settlement accordingly. The insurance adjuster then offers this settlement to the injured victim – in many cases without even leaving the office.

Sounds simple, right? Except that no one but the insurance company knows the data being used to make the claims. Colossus does not take into account that no two accidents are alike, nor are two injuries ever the same. Additionally, the software ignores your own evaluation of your symptoms; only recognizing documented medical records as authoritative.

If, say, you did not go to the hospital after your accident, your claim is automatically lowered in value. Only certain types of treatment are considered “valid” by Colossus, but you would not know which treatments. If you go to physical therapy for up to 90 days, this is considered three months’ worth of treatment. However, if you go to PT for 91 days, you receive a rating of three to six months of treatment, which receives a higher Colossus value.

Other Colossus Concerns

  • How can we be sure that the database is an objective database that is accurate?
  • What if more costly settlements are left out of the database?
  • Are complications after the initial treatment included in the cost analysis?
  • What if the victim suffers symptoms much later down the line?
  • Is the insured really being served by an adjuster simply inputting keywords like broken arm, Howard County, and car crash without even considering the location of the accident or the individual accident victim?

Good Reason to Question Your Colossus Settlement Value

If you are uncertain about the Colossus settlement value on your claim, you do not have to agree with it. You have a right to question it. The software cannot know the specifics of your situation.

If you have questions and do not believe that the Colossus settlement offer is accurate in your case, an experienced personal injury attorney may be able to help you protect your right to a full and appropriate recovery.

Car Accidents and Traumatic Brain Injury – Maryland

It’s common for a person involved in a car accident to seem perfectly normal after thetraumatic brain injury accident but then to deteriorate. The person may be suffering from a traumatic brain injury at the time of the crash.

Approximately 1.7 million people sustain a traumatic brain injury (TBI) each year in the United States. Most quickly recover, but 125,000 people suffer some type of permanent injury from the TBI.

Traumatic brain injuries are caused from a hard blow to the head. In a TBI injury, brain tissue is bruised. Bleeding can occur inside the brain. Brain lacerations or nerve damage may have occurred. Additionally, swelling can cause other types of damage.

Because of the hidden nature of the injuries, the accident victim most often thinks that everything is fine. Unfortunately, a TBI affects the way a person thinks, feels, and ultimately how he or she acts in the world. Symptoms may not be noticeable at first, but loved ones will often notice a change in a person’s behavior. In extreme cases of TBI stemming from a car crash or other blow to the head, a person can actually die from this type of injury.

Cognitive symptoms of TBI That Go Unrecognized

  • Memory problems
  • Problems concentrating
  • Deficits in language use and visual perception
  • Difficulty with abstract reasoning, problem solving, planning, organization, and processing information.

Behavioral Symptoms of TBI

A person’s behavior may change after suffering a TBI in a car crash. For example, a gentle person who never cursed may become increasingly aggressive and swear. Other TBI behavior signs include:

  • Impulsivity
  • Increased physical aggression
  • Anxiety
  • Trouble controlling emotions
  • Shift in sexual functioning
  • Lack of inhibition

Neurological Symptoms of TBI

The motor, autonomic, and sensory brain function may be affected by a TBI. The onset types of problems can be weeks or even months after the initial car accident trauma. Conditions also include:

  • Headaches
  • Seizures
  • Sleep disorders
  • Movement disorders

Distracted Driving Can Cause a Car Accident

Driving Distracted Now a Cause of Car Accidents

Technology advances have produced remarkably sophisticated cell phones. That, together with social media, has resulted in many drivers talking on cell phones while driving; texting while driving; and reading emails while driving. Phone use while driving can now result in a car accident because the driver takes his or her attention off the road, and engages in distracted driving. There are now public safety campaigns to educate drivers, particular young drivers, about the dangers, such as http://www.enddd.org/.

Maryland Law Prohibits Cell Phone Use While Driving

A recent law enacted in Maryland prohibits the use of a cell phone while driving, including texting while driving and cell phone use while driving. There is an exception if the driver is using a hands free device, or making an emergency 911 call.

Man Injured In Train Accident with Car

CSX Train Involved in Baltimore County Train Accident with Car

On Wednesday, August 8, 2012, an intermodal CSX train traveling north from Florida collided with a Volvo at the railway’s intersection with Schaefer’s Lane near Pulaski Highway, reported The Baltimore Sun. The driver of the car in the train accident was injured and transported to Maryland Shock Trauma Center with serious injuries that did not appear to be life-threatening.

Apparently, the intersection did not have barrier arms that descend when a train is passing through, only signs warning of trains. This might have posed a hazard to the car’s driver, making a train accident more likely.

Howard County Train Derails on Same Day as Train Accident With Car

On the same day as the Baltimore County train accident, another CSX freight train briefly derailed in Woodstock, Howard County. The train was traveling east from Cumberland to Baltimore through the railway’s intersection with the 1400 block of Woodstock Road when one of its cars momentarily came off the tracks, only to return shortly thereafter.

Fortunately, no one was injured in the Howard County train accident. Two train accidents in the same day illustrates the fact that train accidents are more common than many people believe. Catastrophic injuries, and even death, can occur when a car is involved in a train wreck.
