Car Accident Cases

A 19-year-old young man was rear-ended on an interstate while traffic was stopped due to an emergency. Client sustained traumatic brain injury and other bodily injuries. Insurance company offered $50,000.00. Offer was rejected. After 5-week trial, jury returned verdict for client for $1.8 million.

A 30-year-old woman was a passenger in a medical transport van returning to her home after medical appointment. Van drove off road onto shoulder, colliding with dump truck and flat bed trailer parked on shoulder while grass was being cut along interstate. Van went up ramp of trailer, became airborne, struck dump truck, did a 360 degree “barrel roll” and landed back on highway. Client sustained thoracic spinal burst fracture and cervical spine injury, both requiring surgery and instrumentation. Jury verdict for $792,000.00.

A 23-year-old racetrack employee was struck by a drunk driver driving with a suspended license, causing a traumatic amputation of his arm. Settlement resulted in lifetime payments totaling $2.1 million dollars.

Estate and mother of 7-year-old girl who died in an apartment fire received a six-figure settlement. The clients and other claimants were paid the full insurance policy limits of $1,000,000.00.

64-year old restaurant chef killed when drunk driver was traveling wrong way on divided highway and caused head-on collision. Judgment obtained for surviving widow, surviving daughter, and personal representative of victim’s estate for $3,000,000.00.

Student suffered a head injury and post-traumatic epilepsy when school bus he was occupying was struck by a car traveling through a red light. Settlement resulted in payments totaling $850,000.00.

Nanny sustained permanent injuries after being rear-ended. Jury returned verdict for $337,717.00.

Parents and minor children injured as a result of a head-on collision. Family to receive total of $628,000.00.

Husband killed while riding as a passenger when drunk driver drove off the road, striking a pole. Full insurance policy limits paid to surviving parents, wife, and adult children.

Husband and father killed in head-on collision. Surviving wife and children received full insurance policy limits of $200,000.00.

47-year old father was struck and killed while crossing a street by car whose driver had been drinking at a wedding, leaving a surviving minor daughter. Full insurance policy limits paid.

Church office manager was rear-ended, sustaining permanent injuries. Settlement obtained for $250,000.00.

Homemaker who was rear-ended in car accident, sustaining fractures and serious permanent injuries, received settlement for $250,000.00.

Retired dental assistant sustained serious injuries as a result of head-on collision. Settlement obtained for $300,000.00.

89-year-old retired female accountant injured as a result of car accident received full insurance policy limits for at-fault driver in the amount of $50,000.00, and full policy limits of underinsured coverage for $50,000.00, for a total settlement of $100,000.00.

Woman taking out her garbage was struck by teenage driver who had been drinking. Total settlement in the amount of $262,000.00.

62-year-old landscaper was seriously injured when other driver ran red light and caused collision. Client received full insurance policy limits of at-fault driver, and full insurance policy limits of underinsured coverage, as well as additional payments directly from other driver.

66-year-old retired woman was injured in car accident when other driver violated her right-of-way in intersection. Settlement received in the amount of $165,000.00.

26-year-old male driver and 23-year-old female passenger sustained serious injuries after being struck head-on by a drunk driver. Insurance company for at-fault driver paid each client the full policy limits of $100,000.00.

Motorcycle Accident Cases

Client was riding his 2017 Kawasaki on a beautiful April day. The driver of an SUV made a left-hand turn, violating our client’s right-of-way. The client swerved to avoid the impending collision, but he was unsuccessful. The SUV driver’s insurance company paid the full automobile insurance policy limits ($300,000.00) and the full umbrella insurance policy limits ($1,000,000.00), representing payment of the maximum award possible.

Medical Malpractice/Nursing Home Cases

Note – It is the usual practice in medical negligence cases for insurance companies and attorneys defending health care providers to insist upon confidentiality clauses in settlement agreements that prohibit the injured patient (and their surviving family members in death cases), and their attorney, from disclosing the settlement, including the amounts paid. Because of this, Mr. Smith is unable to report numerous medical negligence and nursing home cases that resulted in substantial recoveries for his clients. 

82-year-old man admitted to Baltimore nursing home for short-term rehabilitation. After discharge, family discovered client’s foot had gangrene, which resulted in amputation. Confidential settlement reached in fifth day of trial.

Estate and surviving children of nursing home resident received substantial, confidential settlement arising out of choking and death of resident.

29-year old pharmacy technician received confidential settlement from hospital after sponge was mistakenly left in abdomen during surgery.

56-year old nursing home resident developed Stage IV sacral decubitus ulcer (bed sore) and sepsis, requiring emergency hospital admission and extensive wound treatment. Confidential six-figure settlement obtained.

An elderly patient who was dropped in a local hospital, sustaining fractures, received a six-figure recovery.

Estate and surviving daughter received substantial, confidential six-figure settlement after 69-year old father, a long term nursing home resident, contracted extensive decubitus ulcers (bedsores) and urosepsis (infection in blood from urinary tract infection).

A nursing home resident, who was known to be a fall risk, was left unattended. She fell and fractured her hip when she attempted to get up out of her wheelchair. Her estate received a six figure recovery.

Other Injury Cases

A 70-year-old woman was making a purchase at the deli counter of a local grocery store. Unknown to her, a store employee moved a loading cart behind her. When client turned around, she tripped over cart and landed on her face, causing permanent post-traumatic headaches. Grocery store chain offered $15,000.00 to settle at pretrial settlement conference, and raised settlement offer to $25,000.00 on morning of trial. Jury returned verdict for $903,496.00.

An out-of-state consultant who slipped and fell on a Baltimore hotel ramp, sustaining a serious ankle fracture, received a recovery of $345,000.00.

Female robotics engineer sustained ankle and spinal fractures when chair collapsed during business meeting. Jury returned verdict for $342,983.00.

High school student sustained traumatic head injury, and other injuries as a result of an assault. Judgment obtained in the amount of $811,922.00.

Woman injured in car accident sued her former attorney for legal malpractice when he failed to file suit or settle her claim before statute of limitations expired. Settlement received for $300,000.00.

Woman went to grocery store and saw “Helicopter” chair on display outside store. The chair collapsed when she sat on it while deciding whether to buy the chair. Grocery store denied all fault. Case settled during trial after judge ruled in client’s favor and found grocery store was negligent for failing to inspect chair after it was assembled, and failing to warn of dangerous condition.

41-year-old computer specialist sustained back injuries while fishing, when another boat collided with his fishing boat while at anchor. Client received full insurance policy limits of $100,000.00.

School guidance counselor and husband were falsely accused of child abuse. Clients sued for defamation and received settlement of $75,000.00.

Minor female and mother sued uncle for sexually abusing the minor when she was 15 years old. Settlement obtained for $90,000.00.
